Science and Technology Ethics re-examines the ethics by which we live and asks the question: do we have in place the ethical guidelines through which we can incorporate these developments with the minimum of disruption and disaffection? It assesses the ethical systems in place and proposes new approaches to our scientific and engineering processes and products, our social contacts, biology and informatics, the military industry and our environmental responsibilities. The volume is multidisciplinary and reflects the aim of the book to (...) promote a state of the art assessment of these issues. Science and Technology Ethics is a much-needed discussion of the scientific developments that have major effects on the way we live. It will be of interest to all students of science and technology and all professionals involved with administrating laws in these fields. (shrink)

In H.M. Advocate v. Grimmond1 the judge in a Scottish High Court trial refused permission for expert psychological evidence to be admitted on behalf of the Crown in a prosecution involving sexual offences against two children. The Crown had sought to lead an expert witness to explain to the jury about patterns of disclosure in child sexual abuse cases. The case was remarkable, not so much for the strict application of the longstanding rule in R. v. Turner that constrains the (...) use in the courtroom of expert evidence from the behavioural sciences, but for the way in which the arguments presented by the Crown in Grimmond resonate with enduring feminist critiques regarding the treatment of women in rape trials. The theoretical issues raised by the decision include the quest for context to counter rigid evidential frameworks, and the choice of a child sexual abuse case as the medium for challenging the boundaries of the admissibility of expert evidence in the courtroom. The ramifications of Grimmond are tangible as legislation intended to benefit children and women has already been enacted by the Scottish Parliament to ameliorate the effects of the decision. This article suggests that while this legislation should be given a cautious welcome it remains to be seen whether the heralded benefits will actually materialise. (shrink)

This article explores some of the issues raised by Munchausen’s Syndrome by Proxy (MSbP) and the relationship between medicine and law, specifically the discourses which feature in the courtroom portraying motherhood and expectations of parenting. These discourses are often hidden yet play a determining role in prosecutions for alleged maltreatment of children involving medically unexplained infant death syndrome. We offer a critique of MSbP and seek to unveil the assumptions about mothers, the parent predominantly affected by the ‘diagnosis’, and mothering (...) that underlie the association of women accused of deliberating harming their children. We suggest such insights are valuable because although the syndrome has never acquired a clear medical or legal definition, it has had repeated appearances in the literature and courtroom over the last 25 years and has more recently attracted attention from government, health care practitioners, academics and the media. We explore these issues through an examination of two recent Court of Appeal decisions in England: those of Sally Clark and Angela Cannings. (shrink)

Macphail’s ‘null hypothesis’, that there are no differences in intelligence, qualitative or quantitative, between non-human vertebrates has been controversial. This controversy can be useful if it encourages interest in acquiring a detailed understanding of how non-human animals express flexible problem-solving capacity (‘intelligence’), but limiting the discussion to vertebrates is too arbitrary. As an example, we focus here on Portia, a spider with an especially intricate predatory strategy and a preference for other spiders as prey. We review research on pre-planned detours, (...) expectancy violation and a capacity to solve confinement problems where, in each of these three contexts, there is experimental evidence of innate cognitive capacities and reliance on internal representation. These cognitive capacities are related to, but not identical to, intelligence. When discussing intelligence, as when discussing cognition, it is more useful to envisage a continuum instead of something that is simply present or not; in other words, a continuum pertaining to flexible problem-solving capacity for ‘intelligence’ and a continuum pertaining to reliance on internal representation for ‘cognition’. When envisaging a continuum pertaining to intelligence, Daniel Dennett’s notion of four Creatures (Darwinian, Skinnerian, Popperian, Gregorian) is of interest, with the distinction between Skinnerian and Popperian Creatures being especially relevant when considering Portia. When we consider these distinctions, a case can be made for Portia being a Popperian Creature. Like Skinnerian Creatures, Popperian Creatures express flexible problem solving capacity, but the manner in which this capacity is expressed by Popperian Creatures is more distinctively cognitive. Those procedures which, at some future date, could constitute the operations resulting in the cloning of a human being are defined as a tool. As humans have been using tools for some two million years, sets of rules or ethics have been devised to make sure that tools are used to promote the maximum benefit and cause the minimum harm. It would, therefore, seem appropriate to consider the human cloning process as one such tool and approach the ethical issues which (...) might govern its use in a manner which has been informed by how we have approached similar instances of new tool development. In this we can be guided by a range of thought experiments and practical considerations. When we combine these two facilities we may conclude that there are some benefits to be gained by the use of the human cloning tool, while there are other aspects of the use of the tool that need to be carefully controlled and regulated. An outline of a pragmatic approach to the initial uses of the tool is described. (shrink)

As a result of a gradual shifting of the resourcing of universities from the public to the private sector, the academic institution has been required to acquire some of its additional funding from industry via partnerships based on research and development. This paper examines this new condition and asks whether the different mission statements or modi operandi of the university vis à vis industry throws up additional ethical issues. While there are conditions where the interactions between industry and the university (...) may be seen to be between partners with some degree of equivalence, many such interactions, lacking this balance, are in danger of generating more concerns. It should also not be forgotten that independent publicly funded research establishments may also play an important role in the production of the innovation and development needed to maintain the strength of an industrial economy. A July, 1990, controversy in British Columbia, Canada, involved a set of audiotapes detailing an apparent abuse of power by the province's attorney general and a relationship between the attorney general and a member of the press. The controversy was covered extensively in local media. A discussion of relevant ethical issues is followed by an analysis of their coverage in the press. Recommendations are made for more effective handling of ethical issues by media organizations and more meaningful reporting of such (...) issues. (shrink)

The majority of papers in this special issue were presented at a conference, ‘The Advancement of Science and the Dilemma of Dual Use: Why We Can’t Afford to Fail’ held on 9–10 November 2007. The conference chairman was Andrzej Górski and its patrons were UNESCO and the President of the Polish Academy of Sciences. Three additional papers on the subject of Dual Use have been included in this issue; the authors are T. A. Cavanaugh , J. Forge and D. Koepsall.

They may not have happened yet; but they are on the way. Reports, conference talks and exhibitions have provided windows into our possible and probable futures. As our ways of living have changed dramatically over the last 20 or so years, so might we expect even more such changes in the next couple of decades? But what changes might be in the offing and how should we as citizens, students, educators, ethicists and concerned individuals deal with them?Not all of the (...) prospects that are in today’s news will emerge and become consolidated as way-of-life changing mediators. Some of the developments that are on the cards may be difficult to scale-up, produce or manufacture. Others will fall by the wayside because of cost issues, lack of financial backing or poor marketing. And there are always issues of safety, real or imagined, to be dealt with as well as the ethical issues entailed. Also it must be appreciated that there is a category difference between the production of a “tool” and the “ .. (shrink)

Conventional wisdom generally seeks to support the notion that we cannot arrive at ethics by considerations of the state of the world. If we do this we are guilty of committing the ‘Naturalistic Fallacy’. This paper seeks to refute these contentions. I it I note that words are tools that humans use with the intention of promoting their survival. This ties into ethics, which are essentially a subset of the words used to promote human survival through their use in expressing (...) intentions of the way humans should behave. So ethics are a product of our evolution and, like words, they occupy the status of survival promoting tools. This paper argues that there is no category difference in the words that we use to describe the world or those used with the intention of promoting particular human behaviours—both are used with the intention of enhancing human survival. There are two key factors which operate on the mind when confronted with such a task: psychology and ethics. The different factors which influence the psychological acceptability of a product for licensure are many and varied; they include perceived need, novelty, education, context and others. Also involved is the regulator’s view of (...) the ethicality of such products and the organisms which make them, with particular reference to those which are genetically engineered. These ethical views are in turn derived by reference to basic systems of ethics which provide guidelines for behavior. It is important for the manufacturers of biopharmaceuticals to be aware of both the psychological and ethical aspects of the regulator’s mind when addressing such individuals with a view to obtaining a license to manufacture a particular biopharmaceutical. We hear much of voodoo science or junk science or even scientific science, in this paper I seek to evaluate and understand how we might approach a description of the qualities of science. In this I base my reasoning on the equivalence of the words science and knowledge. I then note that the application of the scientific method determines how confident we may be in what we hold as knowledge or science (basically a tested guess or hypothesis). The different levels (...) of confidence are reflected in a variety of terms, including: good or bad, junk or valuable, voodoo or reliable. (shrink)

The material presented at this conference pointed to a new dimension in the prosecution of activities that seek to relieve people of disease. While the simple instrument of the placebo may show those interested in the efficacy of physiologically active chemicals the extent to which the chemical of interest is actually active, the surprising outcome of such studies is that the placebo per se is worthy of more general study. This, when taken further, points to the ways in which mind (...) can influence the matter of the body. Of course, mind itself is an activity of matter, so we may retain the experimental approach that has told us about the world outside ourselves to examine the world that is inside our brains. New techniques and approaches to these once intractable problems are now in train. Where they will lead us we cannot predict, but as with the emergence of all new tools, we have to adopt those ethics that will carry us forward with the expectation that we will maximise benefits and minimise harms. Much confusion exists in the definitions of the areas covered by the disciplines of Bioethics and Biotech ethics. This paper seeks to unravel this situation, following a full discussion of the definition of ethics it shows that, although Bioethics is an all-inclusive term, it is generally used for the more specific area of Biomedical ethics. This leaves space for the equivalent level term of Biotech ethics to cover those aspects of the new and old biotechnologies that are not directly concerned (...) with the delivery of health care to humans. Although Archaea inhabit the human body and possess some characteristics of pathogens, there is a notable lack of pathogenic archaeal species identified to date. We hypothesize that the scarcity of disease‐causing Archaea is due, in part, to mutually‐exclusive phage and virus populations infecting Bacteria and Archaea, coupled with an association of bacterial virulence factors with phages or mobile elements. The ability of bacterial phages to infect Bacteria and then use them as a vehicle to infect eukaryotes may be difficult for (...) archaeal viruses to evolve independently. Differences in extracellular structures between Bacteria and Archaea would make adsorption of bacterial phage particles onto Archaea (i.e. horizontal transfer of virulence) exceedingly hard. If phage and virus populations are indeed exclusive to their respective host Domains, this has important implications for both the evolution of pathogens and approaches to infectious disease control.
